Facebook app update rejected

Hello,

I have an existing dating app in the App Store which uses Facebook and the users can download video and picture from their facebook account.


The initial version of the app was approved by Apple without any issues, but an update submission was rejected for the following reason:


"Legal - 5.2.3

Your app allows users to save or download music, video, or other media content without authorization from the relevant third-party sources.

Specifically, your app enables users to download video content, from Facebook.

Next Steps

Please provide documentary evidence of your rights to allow media downloading from third-party sources. If you do not have the requested permissions, please remove the download functionality from your app."


Based on this response I added an copy of my facebook developer page with all facebook approvement but the app was rejected again with the same response.


I have since asked for clarification on what Apple deems to be 'significant account-based features'

It seems as though the App Store Review Guidelines have changed in the last month.

What I can do to get my app approved.


Has anyone else had a similar issue?

What Facebook document do I need to add to get my app approved?

I have send a response to apple resolution center. i have asked them if i can send then my users information for the facebook developer site. So, they can verify my rigths by themself. i am waiting their answer.


But, nobody have yet this problem ?

The issue about 'significant account-based features' is unrelated to the reason you were rejected.
You were rejected because app review decided that the user did not have the rights to download the video they were downloading using your app. It's as if your app enabled a user to parse the HBO website and grab the next Game of Throne's episode. That is what is meant by "Your app allows users to save or download music, video, or other media content without authorization from the relevant third-party sources". It has nothing to do with your relationship with Facebook. You need to appeal the decision and point out that your app only allows a user to download content that Facebook allows them to download. The reelvant agreement is between Facebook and the users of your app.

here the response to my appeal :

"The App Review Board evaluated your app and determined that the original rejection feedback is valid. Your app does not comply with:

Legal 5.2.3

Since the Facebook API does not include the ability to download videos, it is not appropriate for your app to allow Facebook video downloading without the rights to do so.

If you do not have the requested permissions to use this feature, please it from your app.

We hope you will consider making the necessary changes to be in compliance with the App Store Review Guidelines and will resubmit your revised binary."


What can i do to resolve this issure ? I want to publish my update.

Does your app allow a user to download video content that they are not entitled to download? If you believe that the user is entitled to download the video content then you need to justify that belief to app review.


Why do you believe the user is entitled to download the video content that your app allows them to download? Are you certain that the user is entitled to "download video and picture from their facebook account" or might that content be covered by someone else's copyright?

Facebook examine all apps that use their API and give the right after that. They gave me all the necessaries permissions like user_photos and user_videos.

Also, the users that are using my app, only can download their own photos and videos.

What do you think if I propose to Apple to add something like "You attest that you are the owner of the video that you download...". or

"you certify that you have all necessary rights to download these videos..."

If it is, as you wrote, that "the users that are using my app, only can download their own photos and videos" then point that out to App Review. However, if in fact, the users do not own the copyright of what you are calling "their own photos and videos" then Apple's concerns are well founded.


Perhaps if you issued a one-time notice to the user like "Copyright notice. You are only entitled to use this app to download photos and videos for which you own the copyright or for which you have been given explicit permission to download the photo or video from the person who owns the copyright. The copyright is usually owned by the creator of the photo or video not by the person who sends it around." And then before each download you flashed the following notice "Copyright. I own the copyright to this photo/video or I have been given permission to downlaod this photo/video by the person who owns the copyright." with choices "YES" and "NO" and if the user taps "NO" then show the earlier one-time notice.


having a notice that states "I attest...." means nothing if the user can't tap "NO"

Here the response that I have received from Apple :

"In order to allow users to download Facebook videos within your app, you will meed to provide official documentation from Facebook showing your permission to do so. Please be sure to include dates, rights holders' names, your company's name, and relevant signatures.


Once Legal has reviewed your documentation and confirms its validity, we will proceed with the review of your app."


I don' know what style of document I have to ask Apple.


Please help I am lost.

Apple is asking for a signed contract between you and Facebook that explicitly authorizes you to download the content of third-party rights holders.


The underlying issue is that Facebook does not have the right to grant you download rights to third-party content.


Your lawyers can explain all this to you in much greater detail.


Your app will, most likely, continue to get rejected, until your legal team and Facebook's legal team can draft a contract to Apple's legal satisfaction.

Apple is asking you to show them the Facebook document that gives your app the rights to download the content for the user using your app. For example, if the rights are owned by Facebook, that would be some document or posting by Facebook allowing your users to download videos they own to some app that they are using. If the rights are owned by NBC Universal and posted to Facebook by some user, that would be a document from Facebook indicating that Facebook has obtained the rights from NBC Universal to display and to allow your users to download the rights using your app. You will not be able to do either of those - so essentially Appple is telling you "you don't have the right to enable your users to download this video content!" but rather than assert that, they are asking you to show them that you do have the right.


But it gets back to that original question up there somewhere. Why do you believe the user has the right to download the video content in question? The answer to that question will lead you to the relevant 'document' that asserts that right. But your inability to answer that question suggests that they do not have the right to download the content. If I post a cute video of my grand daughter and her cat on my Facebook page then I am allowing others to view it but I do not think I am giving them the right to download it, Friend or not.

What happed in end of story??? Did your got approve?? Or got rejected again?

My app is nothing without this feature. I don't know what to do.

Any solution you got for your app..I have also the same issue to download videos from musically and save into camara roll and my app is also rejected,If anybody has any solution then please help me out..
