Program License Agreement 2.3 - Confidential Nature of Pre-Release Apple Software and Services
Your app or its metadata contains references to a pre-release version of Apple software, products, or hardware. Apps with compatibility references to a pre-release candidate version of an Apple operating system or pre-released Apple products or hardware are not in compliance with the Apple Developer Program License Agreement.

We are unable to approve your app because it was built for iPadOS only using a pre-release version of iPadOS 16. While your app may not support new features in iPadOS 16, we are only accepting iOS 16, iPadOS 15.7, and universal apps at this time. To resolve this issue, resubmit your app built for a released version of iOS or iPadOS. 2.3 From time to time during the Term, Apple may provide You with pre-release versions of the Apple Software or Services that constitute Apple Confidential Information and are subject to the confidentiality obligations of this Agreement, except as otherwise set forth herein.
I compiled and packaged this project with Xcode 14.0.1, why does this problem occur and how to solve it?
I have the same problem. You can't solve it. App Review won't allow iPad apps that are built with Xcode 14 because it includes iOS 16, which isn't released for the iPad yet. I know that Apple calls it iPad OS 16, but App Review sees the "16" and rejects it. I've argued with them, appealed the decision, and they are stuck on "it's prerelease you can't use it!" - even though Xcode 14.0.1 is officially released.
The only workaround is to install Xcode 13 and use it to compile and submit the app. App Review will not budge, there are a lot of posts about how unreasonable they are about this.
