This is way beyond being a 'huge flaw'. It is a critical failure in the notification system, and is literally putting peoples lives in danger. Apple needs to get on the ball ASAP and get this corrected.
FWIW, I just filed a bug report on this. If anybody else on here is an app developer working on an app that uses critical alerts, I encourage you to also file a bug report ASAP. And if you know such a developer, tell them to file one as well.
